Terms of Service

1. Acceptance of Terms

By downloading, installing, or using LumiFrame (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

LumiFrame is a digital photo frame application that allows you to:

  • Display photos and videos in customizable slideshows
  • Store and sync content via cloud services
  • Share albums with family and friends
  • Cast content to external displays (Chromecast, AirPlay)
  • Interact with other users through social features (likes, comments)

3. User Accounts

3.1 Account Creation

  • You must be at least 13 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity under your account

3.2 Account Security

  • Do not share your password with others
  • Notify us immediately of any unauthorized access
  • We are not liable for losses due to unauthorized account access

4. User Content

4.1 Your Content

  • You retain ownership of all content you upload (“User Content”)
  • You grant us a worldwide, non-exclusive, royalty-free license to store, display, and transmit your User Content for the purpose of providing the Service
  • You represent that you have all necessary rights to upload and share your User Content

4.2 Prohibited Content

You may not upload content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights of others
  • Contains hate speech, threats, or harassment
  • Depicts violence, nudity, or sexually explicit material
  • Contains malware or malicious code
  • Impersonates another person or entity

4.3 Content Moderation

  • We reserve the right to remove any content that violates these Terms
  • We may suspend or terminate accounts for repeated violations
  • Removed content may not be recoverable

5. Premium Features

5.1 Subscription

  • Some features require a paid subscription
  • Subscription fees are billed in advance on a recurring basis
  • Subscriptions auto-renew unless cancelled before the renewal date

5.2 Cancellation and Refunds

  • You can cancel your subscription at any time through your device’s subscription settings
  • Cancellations take effect at the end of the current billing period
  • Refunds are handled according to Apple App Store or Google Play Store policies

6. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the App
  • Use automated tools to access the App (bots, scrapers)
  • Reverse engineer or decompile the App
  • Remove or alter any copyright, trademark, or proprietary notices

7. Third-Party Services

  • The App integrates with third-party services (Firebase, AdMob, etc.)
  • These services have their own terms of service
  • We are not responsible for third-party services
  • Links to external websites are provided for convenience only

8. Advertising

  • The free version of the App displays advertisements
  • Ads are provided by third-party networks
  • We do not control the content of advertisements
  • You can opt out of personalized ads in device settings

9. Intellectual Property

  • The App, including all software, designs, and trademarks, is owned by us or our licensors
  • You receive a limited, non-exclusive, non-transferable license to use the App
  • All rights not expressly granted are reserved

10. Privacy

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be error-free or uninterrupted
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results obtained from the App will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Service interruptions or data loss
  • Any damages arising from your use of the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

14. Termination

  • You may delete your account at any time through the App settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, you lose access to your account and User Content
  • Provisions that should survive termination (e.g., liability limitations) remain in effect

15. Changes to Terms

  • We may update these Terms from time to time
  • Material changes will be notified via the App or email
  • Continued use after changes constitutes acceptance
  • If you do not agree to changes, you must stop using the App

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the State of Delaware.

17. Dispute Resolution

  • Any disputes shall first be resolved through good-faith negotiation
  • If negotiation fails, disputes may be submitted to binding arbitration
  • Class action waivers may apply (subject to local law)

18. Miscellaneous

  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign without notice
  • Entire Agreement: These Terms constitute the entire agreement between you and us
